Dear Reader,
Today I am going to share perspectives and opinions related to the CAB & NRC and about the ongoing protests related to the implementation of CAB as a law.
So, CAB is Citizen Amendment Bill and have been passed as a law after the Rajya Sabha cleared the hotly debated and polarising legislation by 125-99 votes.The Bill, seeks to amend the definition of illegal immigrant for Hindu, Sikh, Parsi, Buddhist and Christian immigrants from Pakistan, Afghanistan and Bangladesh, who have lived in India without documentation. They will be granted fast-track Indian citizenship in six years. So far 12 years of residence has been the standard eligibility requirement for naturalization.
Whereas, NRC is National Register for Citizens and is a roster of all those who settled in Assam up to the midnight of March 24, 1971, the first draft of which was published in 2018.
To be eligible to be a citizen of India, people of Assam would have to prove that either they or their ancestors were in India on or before March 24, 1971, the eve of the Bangladesh War.
So, let’s talk about why NRC needed to be put in place and when did it happen in the first place.
The register was initially, specifically made for Assam state. However, on 20th November 2019, Home Minister Amit Shah declared during a parliamentary session that the register would be extended to the entire country. The register was first prepared after the 1951 Census of India and since then it has not been updated until recently.
An amendment was carried out in the Indian Citizenship Act, 1955, the State Register of Citizens for the state of Assam. It forms a part of the National Register of Citizens and has also been held to be legal to contain the names of all persons which appeared at least in any of the Electoral Rolls published for any of the then assembly constituencies within the territorial limits of present-day state of Assam up to midnight of 24 March, 1971 and also of descendants of such persons presently having permanent residence within the state. A person residing in the present state of Assam is also eligible to get his or her name entered in the register, if he or she holds and submit to the registering authority any of certain specific documents issued up to midnight of 24 March, 1971 against his or her name or in the names of his or her ancestor which would prove the holder’s or ancestor’s presence within the territorial limits of the present-day state of Assam. This is a peculiar situation in which any person, who has entered into the territorial limits of the present-day state of Assam up to the midnight of 24 March 1971 from the neighboring country Bangladesh, or any of the person’s descendant, can claim to be an Indian citizen of the state of Assam throughout India by dint of presence of his or her own self or of ancestor’s, within the territorial limits of the present-day state of Assam only but no other Indian states for that matter. In case of descendants, they further have to hold and submit to the registering authority another specific piece of document proving his or her blood relationship with a person whose name did appear in NRC, 1951 or in any of the said Electoral Rolls or whose presence in the territorial limits of the present-day state of Assam is ascertainable with prescribed specific documents.
Now with CAB in place which will be valid throughout the country, it is feared to violate Assam accord that was signed to stop illegal migrants become an Indian citizen post Bangladesh’s independence. Also, since it allows all non-Muslims minorities/sects migrants to become an Indian citizen within six years if they happen to prove their/ancestor’s presence in India before 2014, the legislation attempts to point out a specific community directly challenging the right to equality on human grounds.
On one side where India is criticized for its corrupt state of affairs, it is ironical to see how efficient the government thinks that the CAB can prove to be. Rather, it would add to more unwanted chaos that the country is seeing.
To oppose the bill, a lot of people have protested thus far and the protests continues to rise in many parts of the country especially in the premier education institutions and universities.

Opinions –
- During the independence of India and Pakistan (West Pakistan i.e. the current day Pakistan and East Pakistan i.e. the current day Bangladesh), the twin nation theory was devised so as to make Pakistan a Muslim majority nation and India a Hindu nation. But, the Indian leaders back then took a decision in the interest of the resident population of the country and zeroed in on the idea of India being a secular state with inclusivity of all religions. That also enabled a lot of migrants to become Indian citizens post NRC. Approval of twin nation theory and attainment of secularity by the Indian government was nothing less than contradictory beliefs.
- Irrespective of how much it is debated, the fact is that India continued to get inhabited by a lot of illegal migrants until a very long time right from the beginning of it’s own independence to the independence of Bangladesh and even after that. Assam was the worst affected state with a heavy footfall from Bangladeshi’s migrants that made the situation worse for the local resident citizens. Then came the “Assam Accord” after the local student unions fought for 5 years and modern NRC was signed. In reality, the illegal migration continues to happen till date from people coming in from Myanmar in the east to people coming in from Pakistan in the west.
- Up until last week, a foreign migrant was needed to spend 12 years in the country to qualify for an Indian citizenship. With CAB in place, the tenure has been reduced to 6 years for all non-Muslims who are able to prove their/their ancestor’s presence in the country before 2014. This no doubt would make it very easy for a lot of people to apply for the citizenship. Once done, there’d be a lot of people added up in the government records and would be liable for all kinds of direct benefits from the government. It would be interesting to see how they contribute towards the development of the already fumbling economy .
- On one hand where we are still struggling to procure taxes from a majority of the population, adding in extra citizens doesn’t make it easier to procure taxes. Rather, it would add to the burden of tax allocation. Feeding more & more people with scarce resources will further weaken the economy if not resulting into a total collapse.
- With the current scenarios, it is safe to say that the government doesn’t intend to withdraw the bill and wants to capitalize on the extra votes that the bill brings with itself for 2024 term. Not to forget that the religious sentiments are involved deeply and it has been concluded in the researches that the BJP had always made a solid standing in the elections happened just after such chaotic situations.
Irrespective of the recent turmoil, violence on the innocent students is not justified and completely unacceptable. Especially by the protectors. Considering the fact that our country is the largest democracy, the recent attack by the police personnel on the students is highly condemning.
A lot has happened since the bill was converted into a law. How things takes course further, it would be interesting to see.
Till then, stay put and focus on your priorities. And don’t propagate bias or falseness.
